QBE appeals travel insurance ruling
Insurance company QBE has warned that the Federal Magistrates court has set a dangerous precedent in finding that it unlawfully discriminated against a terminal cancer patient by refusing her travel insurance

A 31-year-old Adelaide woman, Denice Bassanelli, was refused overseas travel insurance not only for her pre-existing condition, but also for loss of luggage and accidental injury.

Last Friday, the Federal Magistrates court ruled that QBE acted unlawfully, and ordered it to apologise and pay $5,000 in damages.

QBE managing director Raymond Jones says an appeal is essential for the industry.

"If you want companies to be able to provide travel insurance to deserving people who are in a position where they are at risk through unknown events and certainly unknown medical conditions then this decision has to be overturned," he said.

"Otherwise you'll find companies saying they don't want to be in the travel insurance market and people will have to find another way of protecting themselves when they travel."
